Terms of Service

Welcome to WaterfowlAI. These Terms of Service (“Terms”) govern your access to and use of the products and services provided by WaterfowlAI, Inc. (“WaterfowlAI,” “we,” “us,” or “our”), including BlindBook, WingID, TerraWing, and any related applications, websites, and APIs (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Services, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you are using the Services on behalf of an organization (such as a hunting club or outfitter), you represent that you have authority to bind that organization to these Terms.

2. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your password and account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Use of Services

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services to violate any applicable federal, state, or local law or regulation, including fish and wildlife regulations
  • Submit false, misleading, or fabricated hunt data or species identifications
  • Attempt to reverse-engineer, decompile, or extract source code from our AI models or software
  • Interfere with or disrupt the integrity or performance of the Services
  • Access or attempt to access another user's account without authorization
  • Use automated tools to scrape, crawl, or extract data from the Services
  • Upload content that is illegal, harmful, threatening, or otherwise objectionable

4. Subscriptions & Payments

Certain features of the Services require a paid subscription. By subscribing, you agree to:

  • Pay all fees associated with your selected plan
  • Authorize recurring charges at the applicable billing interval
  • Subscription fees are billed in advance and are non-refundable except as required by law

We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing. Payments are processed securely through Stripe.

5. Hunt Data & User Content

You retain ownership of all hunt logs, photos, notes, and other content you submit to the Services (“User Content”). By submitting User Content, you grant WaterfowlAI a non-exclusive, worldwide, royalty-free license to:

  • Store, process, and display your User Content to provide the Services
  • Use anonymized, aggregated data derived from User Content for conservation research, species population monitoring, and habitat analysis
  • Use submitted images to train and improve our species identification AI models

You are responsible for ensuring that your User Content does not violate any third-party rights or applicable laws.

6. Conservation Data Sharing

WaterfowlAI partners with wildlife agencies, universities, and conservation organizations to support waterfowl research. Aggregated, anonymized field data may be shared with these partners. Individual-level data is never shared without your explicit consent. See our Privacy Policy for details.

7. AI-Powered Features

Our Services include AI-powered species identification (WingID) and other machine learning features. While we strive for accuracy, AI identifications are provided as informational tools and should not be relied upon as the sole basis for regulatory compliance. You are responsible for verifying species identifications as required by applicable hunting regulations.

8. Intellectual Property

The Services, including all software, AI models, designs, trademarks, and content created by WaterfowlAI, are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Services without our prior written consent.

9. Third-Party Services

The Services may integrate with or link to third-party services (e.g., weather data providers, mapping services, payment processors). We are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is subject to their own terms and policies.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WATERFOWLAI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WATERFOWLAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless WaterfowlAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, or your violation of these Terms.

13. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved in the state or federal courts located in Delaware.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
